Attending university in Bulgaria
Bulgaria offers extremely good environment for university education. No wonder that students from around the world are storming each year the universities in Bulgaria. Those who are accepted will be enjoying high class education, and later, international recognition of their diplomas.
The legal challenges for non-EU citizens
While the students from other EU member states have zero formalities to comply with, students from non-EU countries have to first arrange their residency permits. And this task is often the “deal breaker” for many young men and women.
According to Art.24b from the Law for the foreigners in the Republic of Bulgaria states that those who have been accepted as regular students in Bulgaria, can obtain residency permit. Sounds as clear and easy policy policy to comply with, but it comes with some caveats.
The small print in the law – the wording of the article
The said article says that those who have been accepted as students, “may” obtain residency permit. In Bulgarian legal terms, this represent the so called non-imperative wording. In other words, the lawmakers are empowering the immigration authorities to issue residency permit to foreign students in Bulgaria. However, the immigration authorities are in no way under obligation to do so. This tiny little nuance is in many cases of extreme importance for the candidate, so each application needs to be carried out with utmost care.
The Bulgarian student visa D
Prerequisite for granting residency permit to foreign students in Bulgaria is also that the candidate must possess Bulgarian immigration visa. This is the so-called visa type-D. The visa is issued by the Bulgarian embassy in the country of residence of the candidate. If the candidate can not visit the embassy in his country of origin (or residence), there are some legal ways around. If this is your case, please contact us for consultation.
There are many cases when foreign students have already obtained visa-D and have successfully arrived in Bulgaria. For some reason however, they have not proceeded with their study in the university. In such case, the university informs the immigration authorities and the “would be” student is subject to cancellation of his visa and deportation.

In case you obtain residence permit in Bulgaria, you can apply for residence permit for your wife as well. Please note however that you have to first apply for visa D for yourself and only then you can obtain residence permit. Your wife will also need to obtain visa D prior to her applying for residence permit. Please note about the huge number of rejections even for spouses of Bulgarian citizens. Presuming that you are older than 18, the only possibility for your mother to obtain residence permit is if she is taking care of you due to medical condition.
